The BPTO published for public consultation the draft Resolution about joint ownership of trademark registrations. Interested parties may send suggestions and comments until June 20, 2019.
The Brazilian Patent and Trademark Office (“BPTO”) is preparing to implement proceedings for (a) trademark registration in a multiclass system; (b) joint ownership of trademark registrations; (c) divisions of trademark registrations and applications; and (d) trademark registrations under the Madrid Protocol. Four resolutions were published dealing with trademark registrations under these conditions.
The BPTO published the public consultation on the draft Resolution about joint ownership of trademark registrations. The proposed Resolution provides, among other issues, that all owners must effectively and legally exercise the activities covered by the mark, and that the administrateive proceedings must be carried out by all owners or by a legal representative with powers to represent all of them.
Interested parties may send suggestions and comments until June 20, 2019. After such deadline, the BPTO will present the proposals received, the responses to the contributions and the final text of the Resolution.
