President sanctions law that increases penalties for cyber crimes.

The Presidency sanctioned a law that modifies the Brazilian Penal Code, in order to aggravate penalties applicable to offenses committed in and by cybernetic means. Approved by the National Congress in May 2021, Law 14,155/2021 is seen as an attempt to contain the increase in the number of crimes committed via the Internet in 2020.

Among the changes proposed by the law, it is noted an increase in the penalty of the crime of breaking into computer equipment to obtain, modify or destroy data, from 3 months to 1 year of detention, to 1 to 4 years of imprisonment. At the same time, the norm establishes a penalty of imprisonment from 2 to 5 years, plus a fine, if such invasion causes the receipt of private electronic communications, trade secrets, among other confidential data.

The expectation on the part of specialists is that the law will produce a pedagogical effect, inhibiting the practice of such crimes by cybernetic means.
