On February 29, 2024, the Brazilian Patent and Trademark Office (BPTO) announced in its website that it is on the verge of reaching the limit of 100 participation requests per annual cycle utilizing PCT results as the basis for requests within the scope of Phase IV of the Patent Prosecution Highway (PPH) Pilot Project.
We strongly recommend our clients who seek to expedite examination proceedings in Brazil and have received favorable opinions from the International Searching Authority for their corresponding PCT applications to promptly file their PPH entry requests.
Once we meet the number of 100 requests, it will only be possible to file new requests through this avenue when a new cycle begins, starting from January 1, 2025.
