The President confirms Brazil’s accession to the Madrid Protocol
The President of the Republic of Brazil, Jair Bolsonaro, signed the instrument of Brazil’s accession to the Madrid Protocol on June 25, 2019, as approved by the Bill of Legislative Decree No. 98/2019. The Madrid Protocol will come into effect at the international level 90 days after the filing of the accession instrument before the World Intellectual Property Organization (WIPO), and shall be internally enacted within the same deadline. Due to the Madrid Protocol, the prosecution of trademark registrations in the member countries will be simplified, with a reduction of administrative fees and bureaucracy, and the BPTO will have to conclude the examination of trademark applications within 18 (eighteen) months. The accession to the Madrid Protocol will encourage the exportation of Brazilian products and services, due to the simplified trademark registration proceeding. The implementation of the agreement by the BPTO is expected to occur in October 2019. For further information, please do not hesitate to contact us.
