On September 10, 2019, the Brazilian PTO released the 3rd edition of the Trademark’s Guidelines, which includes the new procedures for the implementation of the Madrid Protocol, which will enter into force as of October 2, 2019.
The Brazilian PTO also published Resolution No. 247/2019 regarding trademark registration under the Madrid Protocol and Resolution No. 248/2019, with deals with trademark registration in a multiclass system. On September 3, 2019, the Brazilian PTO had published Resolution No. 245/2019, which provides for joint ownership of trademarks, and Resolution No. 244/2019, regarding the division of trademark applications and registrations.
All Resolutions will enter into force as of October 2, 2019, but submissions under the new provisions will only be available to users as of March 9, 2020.
