Industrial designs: new procedure in force
On July 25th, 2023, the Brazilian Patent and Trademark Office (BPTO) announced that Brazil has joined the WIPO Digital Access Service (DAS) for prosecution of industrial designs.
As of August 1st, 2023, the BPTO will accept the submission of the WIPO-DAS code, at the filing date of the application or within 90 days, granting access to the official priority document. This measure will serve as a tacit declaration that the application filed in Brazil is covered by the priority document, eliminating the need to submit a simple Portuguese translation of such document.
