On June 17, 2024, the Brazilian Patent and Trademark Office (BPTO) announced that it is on the verge of reaching the limit of 800 participation requests per annual cycle within the scope of Phase IV of the Patent Prosecution Highway (PPH) Pilot Project. In 2023, the BPTO reached this limit in July. Now, we are approaching this threshold one month earlier.
We strongly recommend our clients who seek to expedite examination proceedings in Brazil and have received favorable opinions from any of their corresponding applications filed in patent offices partners of the BPTO in this project to promptly file their PPH entry requests.
Once we meet the number of 800 requests, it will only be possible to file new requests through this route when a new cycle begins, starting from January 1, 2025.
